Armor Legal Terms and Conditions

LEGAL TERMS AND CONDITIONS OF USE

By purchasing body armor you agree to and understand:

  • That plate carriers sold by 80% Arms are made from NON-ballistic material.

  • That body armor is not bulletproof but only bullet resistant. Body armor is good for protection, but if a bullet strikes you there is always a risk of being injured or killed. 

  • Buyers will not test body armor by wearing it and intentionally be shot by a firearm.

  • Connecticut laws restrict sales of body armor and or products related to body armor; 80% Arms will not sell or deliver these items to any billing or shipping address in Connecticut. Law enforcement officers and agencies are exempt from this condition. Please call for ordering options.

  • Even if the impact from a bullet is absorbed by the body armor vest or plate, defeating the bullet may cause some injuries ranging from severe bruising, broken bones, and possibly serious internal injury which could result in death.

By purchasing armor from 80% Arms you agree to be bound by these legal terms and conditions and that you are:

A US Citizen

Of the legal age to purchase or own the items (at least 18 years of age or older).

Purchasing items on your own behalf and are not purchasing on behalf of someone else in order to avoid complying with these Legal Terms and Conditions of Use.

Purchasing the item(s) on your own behalf and not on behalf of someone else in order to avoid complying with these Legal Terms and Conditions of Use.

Assuming all risk of use (or misuse) of the item(s) purchased.

Not a felon

Not legally barred from purchasing, possessing, or using items purchased.

Legally permitted to own body armor and are conforming with all local, state, or federal laws.

 Only using the items(s) purchased for lawful purposes.

 

You, the Buyer, agree to fully and completely release, never bring any action in any court of law against, and to indemnify, defend, and hold harmless 80% Arms for any and all liability stemming from your purchase, possession, or use of the item(s). Illegally purchasing, possessing, using body armor or other items sold by 80% Arms may result in severe legal consequences to you, up to and including incarceration. 

80% Arms assumes no liability for the use or misuse of any items(s) sold or donated including without limitation any incidental or consequential liability. ALL WARRANTIES, INCLUDING THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY, ARE HEREBY EXCLUDED. NO ORAL AGREEMENT OR WARRANTY OF ANY KIND SHALL BE BINDING UNLESS IN WRITING AND SIGNED BY 80% ARMS. Statements, images, or descriptions are informational only, and not made or given as a warranty in any way. 80% Arms specifically disavows any other representation, warranty, or liability related to the condition or use of the items sold. 80% Arms does not cover any consequential damages, and its liability is limited to repairing or replacing defective items. Every item is sold “AS IS'' and “WITH ALL FAULTS”. The entire risk to the quality and performance of the product is with the buyer.

Returns and Exchanges:

Returns and exchanges are accepted within 10 days of delivery. Returned product must have all original packaging and tags. Items showing use will not be accepted. All return shipping costs are the sole responsibility of the customer. A 10% restocking fee is applied to returned items.

By visiting our website and purchasing something from 80% Arms, you engage in our “service” and agree to be bound by our Terms, including those additional terms and conditions and policies referenced elsewhere on the website.

EAR & ITAR NOTICE:

80% Arms Level III rated ballistic rifle plates are under control of the Commerce Department’s Bureau of Industry and Security (BIS) and administered under the Export Administration Regulations (EAR) which remain subject to the export control laws of the U.S . Government. Export or retransfer of Level III rifle plates by any means to any foreign end user, or for any other end user, whether in the U.S., or abroad without the written approval of the U.S. Department of Commerce, is prohibited.

80% Arms Level IV rifle rated body armor plates fall under the jurisdiction of the International Traffic in Arms Regulations (ITAR) and are subject to eth export control laws of the U. S. government. Export or transfer of Level IV Rifle Plates by any means to any foreign end user, or for any other end use, whether in the U.S. or abroad, without written approval of the U. S. Department of State is prohibited.

The sale, transfer, transportation, or shipment outside of the U.S of any product prohibited or restricted for export without complying with U.S. export control laws and regulations, including proper export licensing, documentation or authorization, is strictly prohibited and may result in civil penalties and/or constitute a federal crime.

Products purchased from this website may contain hardware and/or technical data within the definition of 15 CFR Chapter VII, Subchapter C – EXPORT ADMINISTRATION REGULATIONS Part 730 through 774, as well as 22 CFR Chapter I, Subchapter M – INTERNATIONAL TRAFFIC IN ARMS REGULATIONS part 120 through 130, and may be subject to the export control laws of the United States.

The unauthorized reproduction, dissemination, or transfer of these products or technical data by any method to a foreign person, whether within the U.S. or abroad without the written authorization of the Department of Commerce Bureau of Industry & Security (BIS), Department of State Directorate of Defense Trade Controls (DDTC), or Department of Treasury Office of Foreign Assets Controls (OFAC) is strictly prohibited by law. 80% Arms will not engage in any transaction that requires the illegal export of any products and will not assist directly or indirectly with the illegal export or re-export of any products.

These laws and regulations require 80% Arms to only sell our products to lawful U.S. persons unless with an approved export license and therefore we use a simple method to verify proof of citizenship/residency before processing and delivering purchased protective products. By placing an order on our website, you agree to these requirements and that a request for your passport, birth certificate, and/or other form of identification may be required.  If you refuse to provide this information your order will be canceled, and a full refund will be provided.
